Public offer for services
This is a public offer from the administration of the GoDonateMe platform located at godonate.me — the “Contractor” or “we”. It sets out the terms on which we provide the platform’s services. Contacts are on the Contacts page.
How the agreement is made. A Viewer accepts the offer by paying for Baits in the checkout form. A Creator accepts it by registering an account. The agreement is concluded at that moment.
The Payment and Refund Terms and the Privacy Policy are also part of the agreement.
1. Definitions
- Platform — the GoDonateMe platform located at godonate.me: the website, its subdomains, widgets and dashboard.
- Contractor (“we”) — the administration of the GoDonateMe Platform: its owner and administrator.
- Viewer (Customer) — the person who pays for an Alert.
- Creator — a blogger, streamer or other content creator registered on the Platform. A Creator does not have to stream: the Creator Page can be used simply to receive support from the audience.
- Creator Page — a page like godonate.me/username where a Viewer pays for an Alert.
- Alert — an on-screen and/or spoken message (alert, text-to-speech, widget). It appears in the Creator’s dashboard, and the Creator may show it on stream or in their content.
- Baits — the Platform’s internal accounting unit, used only to pay for Alerts.
- Creator Reward — what we pay a Creator for content made with the Platform.
- Contractor’s Share — the part of the Alert value we keep. Rates are in the Payment Terms and on the Fees page.
- USDT — the Tether stablecoin. Gas — the blockchain network fee.
- SkinsBack (skinsback.com) — our partner that accepts and values in-game items (skins) when a Viewer pays with them. We hold the agreement with SkinsBack; the Viewer does not need a separate one.
- Heleket (heleket.com) — an independent payment service that accepts crypto payments, converts them into USDT and executes Creator payouts. Heleket sets the conversion rate and network gas itself, under its own rates and rules.
2. Subject
2.1. For the Viewer, we provide a paid service: we sell Baits and use them to trigger the Alert the Viewer chose on the Creator Page.
2.2. For the Creator, we provide the Platform’s features — the Creator Page, Alerts, OBS widgets, the dashboard — and pay a Reward for content made with them.
2.3. We are not a bank, credit institution, money-transfer or e-money operator, or payment agent. We do not accept donations and do not transfer money from a Viewer to a Creator. The agreement with the Viewer and the agreement with the Creator are separate agreements.
2.4. Everything a Viewer pays for Baits becomes our revenue at the moment of payment. We do not hold this money for the Creator and do not act on the Viewer’s instructions for the Creator’s benefit — not as a custodian, commission agent, attorney or agent.
2.5. The Reward is our own obligation to the Creator under our agreement with them. It does not pass to the Creator from the Viewer, and the Viewer has no claims against the Creator or in respect of the Reward.
In short. The Viewer pays us for an alert, and we pay the Creator a reward. These are two separate agreements: we don’t pass money from the Viewer to the Creator.
3. Baits
3.1. Price: 100 Baits = 1 USDT (1 Bait = 0.01 USDT). We count in dollars (USDT). Russian-speaking Viewers see amounts in roubles at the single Platform rate (clause 3.6).
3.2. Baits are bought for exactly one Alert and spent on it at once: their number is the Alert price in USDT multiplied by 100. Baits are not kept on a Viewer balance.
3.3. Baits are not money, e-money, a digital currency, a digital financial asset or a security. They cannot be exchanged back for money, transferred to another person or withdrawn.
3.4. When paying in crypto, Heleket accepts the payment and converts it into USDT. The number of Baits follows the USDT amount shown in the checkout form at the time of payment.
3.4.1. When paying with skins, SkinsBack accepts and values the items, and the trade happens between the Viewer’s Steam account and a SkinsBack bot. SkinsBack values the payment in USDT; that amount is locked at the time of payment and sets the number of Baits. A rouble amount, if the checkout form shows one, is for reference only. We do not accept, hold or value the items ourselves.
3.5. The minimum Alert price is 0.5 USDT (50 Baits). A Creator may set a higher minimum; it is shown on the Creator Page and in the checkout form.
3.6. Single rate. The Platform converts roubles and USDT at one USDT/RUB rate: to show amounts in roubles and to convert rouble amounts into USDT. The price of an Alert paid in crypto or skins is locked in USDT (clauses 3.4, 3.4.1) and the rate does not affect it. The current rate is below and in the checkout form, and updates automatically.
3.7. Each operation uses the rate at the time it happened, as shown in the checkout form or the Creator dashboard. Later rate changes do not affect past operations.
In short. 100 Baits = 1 USDT, the minimum donation is 0.5 USDT. Baits are bought for exactly one alert and spent at once. They are not money: you can’t keep, transfer or cash them out. We count in dollars and show roubles at one rate.
4. How and when the service is provided
4.1. The service is provided online; nothing is physically delivered.
4.2. The Alert is triggered as soon as the payment arrives:
- crypto — after on-chain confirmation and the AML check;
- Dota 2 and Rust skins — right after the Steam trade is confirmed;
- CS2 skins — after the 7-day Steam Trade Protection hold, counted from trade confirmation.
4.2.1. If the Viewer reverses the trade during the hold under Steam Trade Protection rules, the payment is cancelled: the Alert is not triggered (or is voided if already shown), and nothing is credited to the Creator.
4.3. The Platform can be used from Russia and other countries where this is not prohibited, subject to sanctions restrictions.
4.4. When the service is complete. The service is fully provided once the Alert is registered on the Platform and its value appears on the Creator’s balance as “Credited” or “Pending”, whichever comes first. The Alert does not have to be shown on stream.
4.5. Showing on stream. The Creator does not have to stream or show Alerts publicly, and we do not promise that an Alert will go on air. If the Creator shows Alerts, it is up to them: whether the widget is running and added to OBS, which filters, pre-moderation, delay and volume are set, and whether they are live at the moment.
4.6. The Creator’s decisions. The Creator may choose not to show an Alert: hide, skip or delete it, including before it airs, mute the voice or turn off the widget. The service is still provided, and this is not a ground for a refund.
4.7. How to check. Our systems confirm the service: the operations log and the Alert history in the Creator dashboard. If you’re not sure your Alert went through, contact support with the payment ID and we’ll check its status.
4.8. If a “Pending” status is cancelled after an AML check, for confirmed fraud or through our fault, the service is treated as not provided and section 5 applies.
In short. A Creator may not stream at all and just receive support. If an alert didn’t appear on stream, most often the Creator hid, skipped or filtered it, or their widget wasn’t running. Either way the payment is already on the Creator’s balance — the service is provided.
5. Cancellation and refunds
5.1. You may cancel the service before it is provided. But the Alert is triggered right after payment, so it cannot be cancelled once triggered.
5.2. Payments in crypto and skins are final. A blockchain transaction and a confirmed Steam trade cannot be recalled or disputed through a bank. So we can refund only in three cases:
- the payment arrived, but the Alert was not triggered through our fault;
- you paid the same invoice twice by mistake;
- a crypto payment failed the AML check.
5.2.1. How we refund. Crypto goes back to the address it came from, via Heleket, minus network gas. Skins cannot be returned: SkinsBack has already accepted them. If a skins-paid Alert was not triggered through our fault, we trigger it again, and if that is not possible, we refund its value in USDT to a wallet you provide.
5.3. A refund returns the payment for a service not provided; it is not an exchange of Baits for money. How and when to request one is in the Payment and Refund Terms.
5.4. There is no refund if:
- the Alert did not appear on stream, but the service was provided under clause 4.4;
- the Creator hid, skipped or deleted the Alert or muted its voice — including before it aired and because of its content;
- the widget was off, there was no stream, or the Creator or Viewer had technical problems;
- you changed your mind after the Alert was triggered;
- you picked the wrong Creator, amount or text.
5.5. If an Alert breaches section 9 (insults, threats, prohibited content and the like), you cannot claim a refund because the Creator did not show it.
In short. Payments in crypto and skins are final. We refund only if we made a mistake, you accidentally paid twice, or the crypto failed AML. If the alert wasn’t shown on stream or you changed your mind, there’s no refund.
6. Who may use the Platform
People with full legal capacity who may enter into such transactions on their own under the law of their country, as well as companies and sole proprietors.
We may refuse registration or restrict an account where there are lawful grounds or a risk of breaching this agreement, AML/CFT requirements or the rights of others.
7. Creator account
To receive Rewards, a Creator registers with a working email and accurate details. The Creator is responsible for keeping access safe and for everything done from their account.
Before a payout we may ask for identity verification (KYC) to the extent required by AML/CFT rules and the law. Legally significant notices are sent to the account email.
8. Creator Reward
8.1. The Creator makes content — streams, videos, posts and more — and uses the Platform as they like, including without streaming. We pay the Creator a Reward for Alerts that Viewers triggered on their page.
8.2. The Reward is the value of the Baits spent on Alerts on the Creator Page, minus the Contractor’s Share. This formula is our internal way of calculating our own obligation to the Creator (clause 2.5), and we may change it as set out in section 15. Counting Alerts on a specific page does not make the Reward the money of any particular Viewer and gives the Viewer no rights to it after payment.
8.3. The Reward is not a donation or a transfer from a Viewer. The Viewer is not a party to the agreement between us and the Creator.
8.4. The Reward is paid in USDT to the wallet saved in the dashboard. Usually Heleket executes the payout; if its balance is short, we send it ourselves from our own wallet. Timing and fees are in the Payment and Refund Terms.
8.5. The Creator pays taxes on the Reward themselves, unless the law requires us to withhold them as a tax agent.
In short. The Creator gets the value of alerts minus our share, paid in USDT, and pays their own taxes.
9. What is prohibited
Receiving support from your audience through Alerts is fine, including without streaming. But the Platform may not be used for:
- selling goods, services, digital content or access to it (subscriptions, courses, keys, accounts, game services and the like) where an Alert serves as payment;
- raising money for other people or organisations, including charity or targeted fundraising on their behalf;
- giveaways, lotteries, gambling, investment schemes, pyramid schemes, currency exchange or loan brokering;
- fraud, phishing, social engineering, money laundering, terrorist financing, or evading sanctions and limits;
- content prohibited by law (extremism, CSAM, calls to violence, illegal drug trade and the like);
- threats, insults, spam or infringing others’ intellectual property.
For violations we may delete messages, restrict the account, pause payouts and, where there are lawful grounds, share data with authorities.
In short. Getting support from your audience is fine. Selling goods and services through alerts, raising money for others, or posting prohibited content is not.
10. Moderation and TTS
10.1. The Creator may moderate, hide, skip, delete and replay Alerts at any time, and set up a word filter and pre-moderation. We do not review what the Creator chooses to show, and these choices do not affect whether the service was provided (clause 4.4).
10.2. The Viewer who wrote an Alert and the Creator who airs it are responsible for its text.
11. Intellectual property and user content
11.1. Rights to the Platform, its design, code, marks and logos belong to us or our licensors.
11.2. User Content means images, sounds, text and any other material a Viewer or Creator uploads to or sends through the Platform: the text and nickname of an Alert, the avatar, page banner and description, alert sounds and images, widget designs. By uploading User Content, you warrant that you hold all the rights and permissions needed to upload and display it, including those of the rights holders and of the people shown in it, and that it does not break the law or section 9.
11.3. User Content remains the user’s property. The user grants us a non-exclusive, royalty-free licence, for as long as the content stays on the Platform, to store, process, reproduce and display it, including on the Creator’s stream, as far as needed to provide the services.
11.4. If a rights holder sends a substantiated claim or the content breaks this offer, we may hide or remove it without notice. The user settles third-party claims about their User Content on their own and at their own expense (section 14).
In short. Upload only what you have the rights to: your own images and sounds, licensed ones or ones you are allowed to use. The content stays yours; we display it so your page and alerts work.
12. Third-party services
12.1. The Platform relies on blockchain networks, Steam and other services used to provide it. We do not guarantee they will work without interruption; payment methods and networks may change.
12.2. We are not affiliated with Valve Corporation or Steam in any way: we are not their partners or representatives and are not endorsed by them. Steam, Counter-Strike 2, Dota 2 and related marks belong to Valve Corporation; Rust belongs to Facepunch Studios. These names are used only to describe a payment method.
12.3. Item trades follow Steam’s rules. Holds, trade reversals, account restrictions and Steam outages are outside our control.
12.4. Skins and SkinsBack. Our partner SkinsBack (skinsback.com) accepts, values and later resells the skins used to pay for Alerts, under an agreement between us and SkinsBack. The Viewer does not enter into a separate agreement with SkinsBack. The Steam trade happens between the Viewer’s account and a SkinsBack bot. We receive from SkinsBack only the valuation of the payment to calculate Baits, and do not accept, hold, value or sell items ourselves.
In short. We’re not affiliated with Steam or Valve. If Steam reverses a trade, restricts an account or goes down, we can’t change that. Our partner SkinsBack accepts and values skins — we never touch them and only receive the valuation of the payment.
12.5. Crypto and Heleket. Viewers’ crypto payments, their conversion into USDT, network gas and Creator payouts in USDT are technically handled by the independent service Heleket (heleket.com). It is not our agent, commission agent or attorney. Heleket is responsible for accepting payments, the conversion rate and network gas under its own rates and rules: we do not set these rates and do not receive the difference. Our withdrawal fee is 1 USDT (Payment Terms, section 5).
In short. Crypto payments, conversion, gas and USDT payouts are handled by our partner Heleket at its own rates. We don’t set the rate or gas and don’t keep them; only the 1 USDT withdrawal fee is ours.
We may engage others to help provide the service and are responsible to the Viewer for their actions as for our own.
Links to third-party sites are provided for information. We do not control those sites and are not liable for losses from following such links.
13. Liability
13.1. The Platform is provided “as is”. We are not liable for user content, USDT rate changes, a wrong wallet address, account compromise caused by the user, or failures of blockchain networks, Steam and other services.
13.2. To the Viewer, our liability is limited to the price of a paid service that was not provided.
13.3. To the Creator, our liability is limited to the Reward credited to their Platform balance and not yet paid out. Other losses, including lost profit, are not compensated.
13.4. If the balance was earned fairly and without breaching this agreement, the Creator can withdraw it as and when set out in the Payment and Refund Terms, including after the agreement ends. Withdrawals may be paused during checks under section 7 and the Payment Terms (KYC, AML, requests from authorities).
13.5. Amounts credited as a result of fraud, payments that failed the AML check, a reversed Steam trade or a breach of section 9 are not fairly earned: we may deduct them from the balance or withhold them as the law allows.
13.6. These limits do not apply where the law does not allow them, including in cases of intent.
In short. To a Viewer, the most we return is the price of a service not provided. To a Creator, we answer for their Platform balance: fairly earned money can always be withdrawn. Fraudulent and cancelled payments are deducted from the balance.
14. Indemnity
A user who breaches this agreement, the law or the rights of others compensates us for proven losses and reasonable costs.
15. Term, termination and changes
The agreement with a Viewer lasts until the service is provided or the payment is refunded. The agreement with a Creator lasts until the account is deleted. A Creator may end it at any time; we pay out the available Reward within a reasonable time unless the law forbids it.
A new version of the offer is published on the site and applies from the date stated in it. Services already paid for remain under the version in force at the time of payment.
16. Governing law and disputes
Send claims to support@godonate.me. We answer refund requests within 10 calendar days and other claims within 30 calendar days. A pre-trial attempt to settle the dispute is mandatory; after that, the dispute goes to court under the applicable jurisdiction rules. A consumer may sue at their place of residence.
The language of the agreement and of communication between the parties is Russian. Documents in other languages are provided with a Russian translation.
If a party does not react to a breach straight away, it does not lose the right to protect its interests later or in similar future breaches.
17. Force majeure
Neither party is liable for failure to perform caused by force majeure that it could neither foresee nor prevent by reasonable means. The affected party notifies the other within 30 business days. If such circumstances last longer than 60 business days, either party may withdraw from the agreement.
